Tupelo to mandate the 3-foot rule

TUPELO - The mother of a teenager killed this summer while bicycling U.S. Highway 6 watched Tuesday as the City Council passed a new rule enforcing biker's rights.

Liria Frerer had told the council just moments earlier that her son, Tupelo High School student John Paul, was killed by a trucker on a clear August day despite wearing bright clothing and following the traffic rules.

But too few motorists notice bicyclists, she said, making them vulnerable to injury or death.

"The importance of this law is about education and awareness," Frerer said at the podium, where she paused more than once to maintain her composure.

The measure passed unanimously and received a standing ovation from the numerous residents who had gathered to support Frerer at City Hall.

According to the new ordinance, motorists must either switch lanes or provide a 3- to 6-foot buffer zone when passing someone on foot, horseback, bicycle, motorcycle, scooter or farm equipment.

Lane switching is required on roads with more than one lane running in the same direction, otherwise the buffer goes into effect. It mandates 3 feet for passenger vehicles and 6 feet for commercial vehicles.

The current ordinance, which is identical to the state code, simply requires motorists to be careful and to honk when passing pedestrians, cyclists, children, or "any obviously confused, incapacitated or intoxicated person."

Although the new rule doesn't specify a punishment for violators, Police Chief Harold Chaffin said state law allows for up to a $500 fine and six months in jail.

"Without the laws to back it up, there's really nothing our policemen can do," said Candy Wheeler, a Tupelo resident and avid cyclist who also spoke at the meeting.

The new ordinance goes into effect in 30 days and will kick off a municipal public-awareness campaign about road safety, said city Senior Planner Renee Autumn Ray.

Ray is leading an effort to encourage more bicycling and walking in the community and has held a series of public meetings on the topic. The meetings helped develop the idea of the recently passed ordinance, she said.

This law will only take effect on city-owned roads, so no, it would not be enforceable on Highway 6. However, the MS State Legislature is being lobbied for a state-wide law in 2010. Such a law died in committee in 2009 (I believe). Also, even though this ordinance only affects drivers on city roads, the hope is that a PSA campaign will be noticed by people who live outside city limits and may make them more aware when they drive, even if it's not on a city road.

Would this law actually have any effect on the highway where the young man was killed? Hwy 6 is a state highway, and what about the Natchez Trace? Will there be signs? How will drivers know about this?

It's a good step, but unless it's a state mandated law, and is taught in driver's ed and tested upon when you get a license, it appears it will have no effect.

Bravo Tupelo. This is good news. Your City Council has adopted a 3-foot rule requiring motorists to give cyclists at least 3 feet clearance when passing from the rear. I want to commend Tupelo's City Council members for giving your city's cyclists this added protection. Ms. Frerer's comment at the Council meeting was absolutely right when she said, "The importance of this law is about education and awareness." That is where the true value of this rule is found, as a tool to educate motorists on what is and is not a safe passing distance when passing a cyclist from the rear--at least 3 feet, please. Of course, the more space the better, but cyclists need at least this amount of space to be safe.

Changing motorist behavior will save lives, but it is also important to understand that changing cyclist behavior is where we can make the greatest impact on cyclist safety because cyclists, not motorists have a very strong personal interest in modifying their behavior to be visible and predicable...the keys to safe cycling. Indeed, cyclists can solve a majority of their own problems by riding visibly and predictably.

Bicycles and motor vehicles are going to share the roads and there is a lot of work to do in helping both motorists and cylists become more responsible and courtesous on our roads. Now, it will become safer to ride a bicyle in Tupelo thanks to the City Council's action. And when you make cycling safer it can encourage non-cyclists to give the sport a try. As more people appreciate and enjoy cycling, we improve safety for everyone. That will be great news.

When I was a child (long ago), we were taught to ride on the right with traffic and walk facing traffic. I encounter walkers and riders on both sides of the street in the Jackson area. Are children being taught the rules of the road, or have they changed?
